Grant / Hibah Documentation

An Akta Hibah is a formal notarial deed executed before a Land Conveyancer (PPAT) through which property or real estate assets are legally transferred as an absolute gift without financial consideration, most frequently between direct family members, spouses, or descendants.

Under the Indonesian Civil Code (KUHPerdata) and Land Registration Regulations, property grants must strictly respect statutory forced heirship shares (legitieme portie) to prevent future civil claims by other legal heirs. All municipal transfer taxes (BPHTB) and income gift taxes must be calculated, assessed, and remitted prior to deed registration.

Today Consultant oversees comprehensive genealogical and title due diligence, drafts valid deeds of grant, obtains necessary spousal and sibling consents, and registers the newly amended land title certificates at the National Land Agency (BPN).
